THE HUB SUNBURY MEMBERSHIP & SERVICES AGREEMENT

By joining, purchasing, booking or using a service at The Hub Sunbury, you agree to these Terms & Conditions and the Member House Rules.

This Agreement applies to all services you use at The Hub Sunbury, now or in the future. You only need to accept this Agreement once. If you later change your membership or use an additional service, this Agreement continues to apply.

1. MEMBERSHIP AND USE

Membership gives you a personal, limited right to use the Hub services and workspace made available to you.

The Hub Sunbury Pty Ltd retains management and control of the premises, common areas, access, security and services.

This Agreement does not create a lease, tenancy, sublease or proprietary interest in the premises.

You must use The Hub and its services only for lawful business purposes and comply with these Terms & Conditions and the Member House Rules.

2. FEES AND PAYMENT

Fees for memberships, services and bookings are those displayed or confirmed through The Hub Sunbury's nominated membership, booking or payment system at the time the service is purchased or booked.

All fees are exclusive of GST unless stated otherwise.

Recurring membership fees are payable monthly in advance through The Hub's nominated payment system.

Casual Hot Desk, Private Client Meeting Room and Boardroom bookings are payable at booking unless otherwise agreed.

You authorise The Hub and its payment provider to process amounts properly due using your nominated payment method.

The Hub may suspend access or services if amounts remain unpaid.

3. ACCESS AND SECURITY

Access is limited to the services and areas available under your membership or booking.

Keys, access devices, passwords and security codes must not be shared.

You are responsible for employees, contractors, guests and visitors you bring into The Hub.

4. BOOKINGS

Hot desks, the Private Client Meeting Room and Boardroom are subject to availability and must be booked through The Hub's nominated booking system where required.

Bookings apply only to the date, time, duration and service booked.

5. DAMAGE AND CLEANING

You are responsible for loss or damage caused by you or your employees, contractors, guests or visitors, excluding fair wear and tear.

The Hub may recover reasonable repair, replacement, additional cleaning or remediation costs.

All areas must be left clean, tidy and ready for the next user.

6. INTERNET AND SHARED FACILITIES

Wi-Fi and shared facilities are provided for normal business use.

You must not use The Hub's internet or technology for unlawful, offensive, harmful or security-compromising activities.

Furniture, equipment, fixtures and other property supplied by The Hub remain the property of The Hub.

7. SAFETY

You must follow emergency, evacuation, workplace safety and reasonable site instructions and promptly report hazards, incidents, damage or maintenance concerns.

8. INSURANCE AND RESPONSIBILITY

The Hub maintains insurance appropriate to its operations.

Each Member is responsible for maintaining insurance appropriate to their own business activities, including public liability and professional indemnity insurance where applicable, and insurance for their own property and equipment.

To the extent permitted by law, The Hub is not responsible for indirect or consequential loss, loss of profits, business interruption, loss of data, or loss or theft of Member property.

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.

9. INDEPENDENT BUSINESSES

Members operate independently from The Hub.

Nothing in this Agreement creates an employment, agency, partnership or joint venture relationship.

The Hub is not responsible for services, advice, acts or omissions of a Member or their business.

To the extent permitted by law, Members are responsible for claims, loss or damage arising from their business activities or caused by their employees, contractors, guests or visitors.

10. PRIVACY AND CONFIDENTIALITY

Members must respect confidential information belonging to The Hub and other users of the premises.

The Hub may collect and use personal information reasonably required to administer memberships, bookings, payments, security and communications in accordance with applicable privacy law.

11. MEMBERSHIP CHANGES, SUSPENSION AND TERMINATION

The Hub may suspend access or terminate membership for serious or repeated breaches, unlawful conduct, non-payment, safety or security risks, or conduct that materially interferes with other users.

Ending a membership does not remove liability for amounts already due, damage caused or obligations that continue after termination.

12. TRANSFER AND SHARING

Memberships, workspaces, bookings and Professional Business Address rights cannot be assigned, transferred, resold, sublicensed or shared without The Hub's prior written consent.

13. CASUAL HOT DESK

Casual Hot Desk use is subject to availability and does not create an ongoing membership.

Meeting rooms and the Boardroom are booked separately.

14. HOT DESK MEMBERSHIPS

The 1 Day Membership provides 1 coworking day per week.

The 3 Day Membership provides 3 coworking days per week.

The Unlimited Membership provides access in accordance with The Hub's current membership inclusions.

Shared Hot Desk Memberships do not provide a permanently reserved desk.

Unused days under the 1 Day and 3 Day Memberships do not roll over.

Memberships are personal and cannot be shared.

15. PRIVATE OFFICE MEMBERSHIP

Private Office Memberships have a 12 month minimum term.

Fees are payable monthly in advance by automated payment.

The Member commits to the full 12 month minimum term. Ceasing to use or vacating the office before the end of the minimum term does not by itself end the obligation to pay membership fees for the remainder of the minimum term, unless The Hub agrees otherwise in writing or applicable law requires otherwise.

After the initial 12 month term, the membership continues month to month unless ended in accordance with the applicable notice arrangements.

The workspace must not be transferred, shared, sublicensed or made available to another business without The Hub's written approval.

The Hub retains management and control of the premises. Where reasonably necessary for the operation, safety or management of The Hub, The Hub may relocate a Private Office Member to a reasonably comparable workspace.

Private Office Members may use or book other Hub services under this same Agreement without entering into another agreement.

16. PROFESSIONAL BUSINESS ADDRESS

The Professional Business Address service permits approved use of The Hub Sunbury address as a professional business address only.

No mail receipt, collection, handling or forwarding is included.

The address must not be used as a postal or mailing address.

This service does not provide a desk, office, meeting room, Boardroom, reception service or right to occupy the premises.

You must not represent that you own, lease or exclusively occupy The Hub premises.

You are responsible for confirming that the address may lawfully be used for your intended business registrations, licences, directories or regulatory purposes.

When the service ends, you must promptly remove The Hub Sunbury address from business registrations, regulatory records where applicable, websites, Google listings, directories, stationery, advertising and marketing.

17. PRIVATE CLIENT MEETING ROOM

Payment is required at booking.

Cancellation or rescheduling must be made at least 24 hours before the booking start time.

Cancellations made within 24 hours and no-shows are non-refundable.

Members who have already accepted this Agreement may book the room later without entering into another agreement.

18. BOARDROOM

Payment is required at booking.

Cancellation or rescheduling must be made at least 24 hours before the booking start time.

Cancellations made within 24 hours and no-shows are non-refundable.

Members who have already accepted this Agreement may book the Boardroom later without entering into another agreement.

19. MEMBER HOUSE RULES

Respect: Treat everyone with courtesy and professionalism. Harassment, discrimination, bullying or disruptive behaviour will not be tolerated.

Noise: Be mindful of noise in shared areas. Use headphones where appropriate. Phone calls should be taken in the soundproof phone box, a private office or meeting room where possible.

Clean Up: Leave desks, meeting rooms and common areas clean and tidy. Wash and put away dishes after use and dispose of rubbish appropriately.

Security: Do not share keys, access devices or security codes. Ensure doors are secured when required and report lost keys or security concerns immediately.

Visitors: Members are responsible for their guests and visitors.

Internet & Technology: Internet must not be used for illegal, offensive or inappropriate activities.

Property: Members are responsible for their own belongings.

Safety: Follow emergency procedures and report hazards, damage or maintenance issues immediately.

Smoking & Vaping: Smoking and vaping are not permitted inside The Hub Sunbury premises or directly out the front of the premises.

Community: Be kind. Be professional. Be respectful.

20. GOVERNING LAW

This Agreement is governed by the laws of Victoria, Australia.

By accepting these Terms & Conditions through The Hub's membership or booking system, you confirm that you have read, understood and agree to this Membership & Services Agreement and Member House Rules.
